Terms of Service

1. Description of Service

Poof is a web application that transforms personal photos into creative content including coloring pages, dot-to-dot puzzles, comic-style art, comic stories, mini storybooks, jigsaw puzzles, and interactive canvas experiences. The service uses AI technology to process and transform your images.

2. Accounts

To access most features, you must sign in using your Google account. You are responsible for maintaining the security of your account and for all activities that occur under it. You must provide accurate information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Poofies (Virtual Currency)

Poof uses a virtual currency called "Poofies" to access certain features:

• New users receive a limited number of free Poofies upon account creation.
• Additional Poofies can be purchased in packages through our in-app store.
• Each transformation feature has a specified Poofies cost displayed before use.
• Poofies have no monetary value outside of Poof and cannot be exchanged for cash, transferred to other users, or redeemed outside the platform.
• If a transformation fails due to a service error, the Poofies spent will be automatically refunded to your balance.

4. Payments and Refunds

Poofie purchases are processed through PayPal. All purchases are final. Since Poofies are a digital consumable delivered immediately upon purchase, refunds are generally not available. However, we may issue refunds at our discretion in cases of technical errors, duplicate charges, or unauthorized transactions. If you believe you were charged in error, please contact us promptly.

5. Your Content

You retain ownership of the photos you upload to Poof. By uploading content, you grant us a limited license to:

• Process your photos through AI services to generate the requested transformations
• Store your photos and generated creations on our servers so you can access them
• Display your creations to you and to anyone you share them with via sharing features

You represent that you have the right to upload any content you submit and that your content does not violate any third party's rights.

6. AI-Generated Content

Transformations are generated using AI technology (Google Gemini). While we strive for quality results, AI-generated content may occasionally be imperfect, unexpected, or inaccurate. We do not guarantee specific outcomes for any transformation. Generated content is provided "as is."

7. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Upload content that infringes on any intellectual property or privacy rights
• Attempt to reverse-engineer, hack, or exploit the service or its infrastructure
• Use automated systems (bots, scrapers) to access the service
• Circumvent rate limits or abuse the service in any way
• Use the service to generate content that is harmful to minors

We reserve the right to remove content and terminate accounts that violate these guidelines.

8. Service Availability

We strive to keep Poof available at all times, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the service at any time without notice. We are not liable for any downtime, data loss, or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Poof and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the service. Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements or expectations.

11. Termination

You may stop using Poof at any time. We may terminate or suspend your access to the service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our service. Upon termination, your right to use the service ceases immediately. Any unused Poofies will be forfeited upon account termination.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of Poof after changes are posted constitutes acceptance of the revised Terms. If you disagree with any changes, please discontinue use of the service.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts of the jurisdiction in which we operate.
